Definitions
“You” means the party wishing to engage the services of CWS.
“CWS/us/we” Chartered Wealth Solutions (Pty) Ltd.
“Chartered-Related Companies” means any company related to Chartered Wealth Solutions (Pty) Ltd, including but not limited to: Chartered Wealth Solutions (EC) (Pty) Ltd (FSP No.: 12985), Chartered Financial Planning (Pty) Ltd (FSP No.: 38005), WealthStrat (Pty) Ltd (FSP No.: 44865), Chartered Employee Benefits (Pty) Ltd (FSP No.: 24323), Chartered Legacy and Trust (Pty) Ltd, Chartered Tax (Pty) Ltd, and Pete Wilson & Associates (Pty) Ltd (FSP No.: 3814).
“Personal Information” means any information relating to an identifiable, living, natural person and, where applicable, to an identifiable, existing juristic person.
“PoPIA” Protection of Personal Information Act, 4 of 2013.
“FAIS” Financial Advisory and Intermediary Services Act, 37 of 2002.
“General Code of Conduct” means the General Code of Conduct for Authorised Financial Service Providers and Representatives.
“Representative” means employees appointed and mandated by the FSP to render financial services to consumers on behalf of the authorised FSP.
“CWS/us/we” Chartered Wealth Solutions (Pty) Ltd.
“Chartered-Related Companies” means any company related to Chartered Wealth Solutions (Pty) Ltd, including but not limited to: Chartered Wealth Solutions (EC) (Pty) Ltd (FSP No.: 12985), Chartered Financial Planning (Pty) Ltd (FSP No.: 38005), WealthStrat (Pty) Ltd (FSP No.: 44865), Chartered Employee Benefits (Pty) Ltd (FSP No.: 24323), Chartered Legacy and Trust (Pty) Ltd, Chartered Tax (Pty) Ltd, and Pete Wilson & Associates (Pty) Ltd (FSP No.: 3814).

Introduction
- This Agreement outlines what both you and we need to do regarding Advisory/Intermediary and/or Financial Planning services and only applies to these services.
- This agreement replaces any previous agreements between us.
Acceptance, Termination and Amendment
- This Agreement is considered concluded once the last person involved signs it.
- Either Party can end this agreement for any reason by giving the other Party thirty (30) days’ written notice. After this notice period ends, we’re not required to provide any financial services to you anymore.
- The laws that control the Financial Services Industry are always evolving, therefore, it may be necessary for us to amend the terms of this Agreement to reflect these legal and/or regulatory changes from time to time. As we cannot control these changes, where we have been required to make amendments to this Agreement, we shall endeavour to highlight these changes to you during your routine annual review. Should the legal and/or regulatory changes affect or have an impact on your financial plan, we will let you know when the changes have taken affect.
Services We Provide
- We will provide advisory/intermediary and/or RetiremeantTM planning services to you.
- We’ll customise our services to fit your specific requirements, so it’s crucial that you give us thorough information about your current situation, needs, and goals.
- You must inform us if there are any changes in your circumstances that could affect the advice or services we offer.
- We promise to provide our services honestly and with integrity. This means we’ll handle your affairs carefully, skilfully, and diligently, always prioritising your best interests.
Personal Information
- You agree to provide us with all information and/or documentation required by us in terms of the Financial Intelligence Centre Act, 38 of 2001.
- You agree to allow us to share your personal information with Chartered-Related Companies. This is done to improve the services we provide and to make the process of getting started quicker and smoother.
- You agree to our Privacy Policy, which you can find at https://charteredwealth.co.za/legal-documentation/privacy-policy/, and that you have read and understood it.
- All communication with you, including but not limited to phone calls, WhatsApp’s, emails etc., will be saved on our secure servers for as long as is required by law.
Your Responsibilities
- You’re responsible for providing us with accurate information for us to offer financial services effectively.
- You must inform us of any changes in your situation that could impact the financial services we’ve provided.
- You need to comply with all legal requirements.
- We can’t be held responsible for undisclosed information, missed timelines, recommendations not followed, or risks not accepted:
- You indemnify us against any financial loss that you may suffer as a result of the risks you might face if you don’t follow our advice, implement our recommendations, or choose different transactions than what we and our representatives suggest.
- You agree to accept our recommendations promptly before they’re implemented.
Reviews
- We are required to review Your Plan and/or financial advice on a yearly basis in line with therequirements set out in the FAIS General Code of Conduct.
- Should any of your financial circumstances change before the review date, you must inform usof such changes so that we may take these changes into consideration and apply them to Your Plan and/or advice we review.
Referrals
- We may we refer you to a Chartered-Related Company to render additional services to you,including but not limited to, tax consulting and the drafting of wills. The Chartered-Related company may charge fees which do not form part of this Agreement and will be agreed upon separately with that company.
- Should we deem it necessary, we may refer you to a third party outside of the Chartered-Related Companies. The third party may charge fees which do not form part of this Agreement and will be agreed upon separately with that third party.
- We cannot be held liable for the recommendations, guidance, proposals or intermediary services provided by the third party.
- We will undertake all reasonable measures to ensure that all third parties we use for advisory and/or intermediary service referrals are duly licensed as a Financial Service Provider within the Republic of South Africa.
Transfer of Relationship
- We may, from time to time, restructure our business, including the Chartered-Related Companies. By agreeing to this you:
- Agree to transfer the relationship between you and the representatives or specialists to the new company;
- Authorize the payment of any previously agreed financial fees or commissions to the new company;
- Allow relevant records with product suppliers to be updated accordingly;
- Give authorization for the new company to access necessary information from other parties regarding your investments;
- Agree that the Agreement will continue with the new company after the transfer;
- Accept that the new company and its representatives may access your personal information held by the previous company; and
- Accept that the new company and its representatives may access your personal information held by the previous company.

- We are an FPI Approved Professional Practice™. Our Financial Planning Specialists areCERTIFIED FINANCIAL PLANNER® professionals and are members of the Financial Planning Institute of Southern Africa (FPI). As members of the FPI and CFP® professionals, we are bound by a professional Code of Conduct and therefore if you believe that we may have acted in an unprofessional manner, you may report us to the FPI (www.fpi.co.za).
